The great undoing, called, 'I know'!

UNLEARNING,the human equivalent of Computer formatting!

Life is a never ending process of learning unless one refuses to learn and is repugnant to the basic human instinct about learning. My experience says, this repugnance too is all pervading that plagues certain segments . Especially legal segment is one but is not without exceptions. I have a couple of examples of exception. We had a hard working sub judge while the world was celebrating the turn of the century. He graced the court room just opposite the DBA. I was conducting a complicated civil matter in that court. After a few sessions of arguments at length, the P.O asked me to pause for a while. I complied. He told me in open court in presence of the other side that he had a long innings doing criminal matters, so much so that he could scan a record without detailed perusal but he was weak on the civil side. He clarified that even though he was technically weak, his strength lay in his discerning sense. You can not take me for a ride. He said he knew what and how to elicit what so as to distinguish logic from sophistry. He asked me to be transparent as regards legal provisions I banked upon in applying it to my facts.

I did. 

The case was decided in more optimum manner than I could have imagined, in that if I had got my full relief, my interest elsewhere would have suffered. If I was refused wholly, I would have been in disarray. What was adjudicated was neither. It was आधा तीतर आधा बटेर, neither side sought nor could have sought. It was exactly that adjudication which  delivered best justice in that exact manner as would have contained even a Shylock.

A couple of years later, I happened to meet the judge in a function at Patna close to which he had his posting. I told him about his feat, wondering how could he say he was weak on the civil side.

His reply is the moral of the anecdote. 

He said, he was still weak on the civil side but was equally strong in the art of unlearning. He explained, the greatest weakness of a civil practitioner including a judge was that he thought 'he knew'. The audacity which the term ,'I know', carries, is a forbidding factor, that takes away one's inbuilt instinct of learning with an open mind. 

And you can't have an open mind unless you have mastered one little known craft. That's the craft of 'unlearning'.  

18 years have rolled  by, making most of us computer savvy. And most of us know what  formatting means with respect to a computer system. Once your computer program turns irreparable , you may learn what formatting means , else your system turns into an idiot box , good for nothing. That's exactly what happens to our mind, once formatting is necessitated . In human condition, unlearning is the synonym for the computer language, called 'formatting'.

क्या कहा?

मोदी देश को बेच रहे हैं?

और कांग्रेस देश के लिए खरीद रही थी?

देखें, सच क्या है।

आज जो #निजी_क्षेत्र के ३ सबसे बड़े बैंक है, यानी ICICI बैंक,  HDFC बैंक, और AXIS बैंक - यह तीनों कभी सरकारी बैंक हुआ करती थी, लेकिन पी.वी नरसिम्हा राव सरकार में वित्त मंत्री रहे डॉ.मनमोहन सिंह ने इन्हें बेच दिया!


ICICI का पूरा नाम था इंडस्ट्रियल क्रेडिट एंड इन्वेस्टमेंट कारपोरेशन ऑफ़ इंडिया! यह भारत सरकार की ऐसी संस्था थी, जो बड़े उद्योगों को ऋण देती थी!


एक झटके में वित्त मंत्री डॉ. मनमोहन सिंह ने इसका डिसइनवेस्टमेंट करके, इसे प्राइवेट बना दिया, और इसका नाम और ICICI बैंक हो गया!


आज जो HDFC बैंक है, उसका पूरा नाम हाउसिंग डेवलपमेंट कारपोरेशन ऑफ़ इंडिया था! यह भारत सरकार की एक ऐसी संस्था हुआ करती थी, जो मध्यम वर्ग के नागरिकों को सस्ते ब्याज पर होम लोन देने का काम करती थी!


नरसिम्हा राव सरकार में वित्त मंत्री रहे डॉ. मनमोहन सिंह ने कहा, "सरकार का काम केवल गवर्नेंस करना है, होम लोन बेचना नहीं है!"


डॉ. मनमोहन सिंह  इसे आवश्यक कदम बताते हैं, और कहते हैं, "सरकार का काम केवल सरकार चलाना है, बैंक चलाना, या लोन देना नहीं है!"


और एक झटके में वित्त मंत्री डॉ. मनमोहन सिंह ने HDFC बैंक को बेच दिया! और यह निजी क्षेत्र का बैंक बन गया!


इसी तरह की बेहद दिलचस्प कहानी AXIS बैंक की है!


भारत सरकार की एक संस्था हुआ करती थी, उसका नाम था यूनिट ट्रस्ट ऑफ इंडिया! यह संस्था लघु बचत को बढ़ावा देने के लिए बनाई गई थी! यानी आप इसमें छोटी-छोटी रकम जमा कर सकते थे!


नरसिम्हा राव सरकार में वित्त मंत्री डॉ. मनमोहन सिंह ने कहा, "सरकार का काम चिटफंड की स्कीम चलाना नहीं है!"


और एक झटके में इसे बेच दिया गया! पहले इसका नाम UTI बैंक हुआ, और बाद में इसका नाम AXIS बैंक हो गया!


इसी तरह आज IDBI बैंक है, जो एक प्राइवेट बैंक है! एक समय में यह भारत सरकार की संस्था हुआ करती थी, जिसका नाम था इंडस्ट्रियल डेवलपमेंट कारपोरेशन ऑफ़ इंडिया! इसका भी काम उद्योगों को ऋण देना था! लेकिन डॉ. मनमोहन सिंह ने इसे भी बेच दिया! और आज यह निजी बैंक बन गया है!


अपनी याददाश्त को कमजोर न होने दें कभी!


डिसइनवेस्टमेंट पॉलिसी को भारत में कौन लाया था? जरा सर्च कर लो!


जब नरसिम्हा राव के समय में डॉ. मनमोहन सिंह वित्त मंत्री थे, तब डॉ. मनमोहन सिंह ने संसद में कहा था, "मैक्सिमम गवर्नमेंट, लेस गवर्नेंस!"


उन्होंने कहा था, कि "सरकार का काम व्यवसाय (धंधा) करना नहीं, सरकार का काम गवर्नेंस देना है! ऐसा वातावरण देना है, कि देश के नागरिक यह सब काम कर सकें!"


डॉ. मनमोहन सिंह ने ही सबसे पहले "टोल टैक्स पॉलिसी" लाई थी! यानी "निजी कंपनियों द्वारा सड़क बनाओ, और उन कंपनियों को टोल टैक्स वसूलने की अनुमति दो!"


डॉ. मनमोहन सिंह ने "सबसे पहले एयरपोर्ट के निजी करण" को आरंभ करवाया था, और सबसे पहला दिल्ली का "इंदिरा गांधी एयरपोर्ट" को जी.एम.आर ग्रुप को व्यवसायिक स्वरूप से चलाने के लिए दिया गया!


आज चम्पक उछल-उछल कर नाच-नाच कर, बेसुर राग गाता फिर रहा है, "मोदी ने अपने मित्रों में बेच दिया!"


डॉ. मनमोहन सिंह करें तो - विनिवेश!और मोदी करें तो - देश को बेचा!!

 आखिर क्या है, किसान विरुद्ध?

आखिर क्या है,

बाध्यताएं, किसान-विरुद्ध,

नए किसान कानूनों में,

जिससे तथाकथित, मैं दुहरा दूं, तथाकथित,

किसान आंदोलित हैं?

वैकल्पिक कानून?

प्रधान मंत्री नें इसे वैकल्पिक कानून बताया। उन्हें बताना पड़ा, यही आश्चर्य की बात है। यानी ,जो स्वयं स्पष्ट है,वो भी बताना पड़े, वो भी संसद के पटल से, प्रधान मंत्री को? और बाबजूद इसके, टी वी डिबेट में, संदीप चौधरी जैसे न्यूज़ 24 के एंकर की भौंहें तने, कि पहली बार सुना कि कानून वैकल्पिक भी हो सकता है।

अफसोस, देश बेवकूफों की कैसी जमात को झेल रहा है।

विकल्प का सार।

पराली मामले में सहमती के बाद, किसी एक प्रावधान का  उल्लेख करें, जिसमें किसानों के लिए किसी भी प्रकार की कैसी भी बाध्यता हो।

कोई बाध्यता किसी के लिए है, तो वो किसान के पक्ष में और दूसरे पक्ष (जो किसान नहीं) के लिए है। और सारा विकल्प किसानों के पक्ष में है।

कॉन्ट्रैक्ट फमिंग।

कहते हैं कॉन्ट्रैक्ट फार्मिंग किसान विरोधी है।

 ऐसा क्या? 

तो कानून तो किसान को कॉन्ट्रैक्ट करने के लिए बाध्य नहीं करता, मात्र विकल्प देता।

 इसे सब समझते हैं, बेवकूफों और षड्यंत्रकारियों या आंदोलन जीवियों के सिवा।

भंडारण सीमा।

कहते हैं भंडारण सीमा की बाध्यता जमाखोरों के लिए वरदान साबित होगा, किसानों के लिए अभिशाप। अभिशाप क्यों भाई? बेचना यदि किसान का परमाधिकार है तो फिर खरीदार चाहे जमाखोर हो या मुफ्तखोर, निर्भर तो किसान पर  करता है कि बेचने के विकल्प का प्रयोग वो करता है या नहीं। यदि खरीदार पक्ष पर भंडारण की बाध्यता लगा दी जाय तो प्रभावित डिमांड होगा यानी बाजार भाव गिरेगा जो किसान विरोधी हुआ। भंडारण सीमा का हटना यानी डिमाण्ड में वृद्धि, यानी अधिक भाव जो किसान के पक्ष में है। फिर भी, बेचना या नहीं बेचना, किसान का विकल्प है, खरीदार का नहीं।

कानूनों में सारे प्रावधान, किसान को विकल्प देते हैं, फिर भी बेवकूफों और शातिरों का सवाल खड़ा है, कि इन कानूनों को वैकल्पिक क्यों बताया प्रधान मंत्री ने।

न्यूनतम समर्थन मूल्य।

बेवकूफ यह भी मांग कर रहे हैं कि न्यूनतम समर्थन मूल्य को कानूनी जामा पहनाया जाय। 

यानी, न्यूनतम समर्थन मूल्य के नीचे की ख़रीदगी कानूनन अपराध!

वाह भई।

में खरीदार, किसान विक्रेता।

न्यूनतम समर्थन मूल्य 2,000/-. 

बाजार भाव 1,500/-.

मुझे 2,000/- में नहीं खरीदना। विक्रेता 1,500/- में बेचने को तैयार।

अब क्या होगा?

किसान का माल किसान के घर, खरीदार अपने घर। आखिर व्यापारी किसी और भी सामग्री की खरीद बिक्री में इन्वेस्ट करने का जब विकल्प रखता है तो वो न्यूनतम समर्थन मूल्य संबंधित बाध्यता के पचड़े में क्यों पड़ेगा? फलस्वरूप किसानों को ही वैसे प्रावधानों से पीछा छुड़ाने की मशक्कत करनी पड़ेगी।


वैसे, न्यूनतम समर्थन मूल्य, इन कानूनों से सरासर भिन्न मुद्दा है। इन कानूनों से इसका कोई लेना देना है नहीं। सरकारी स्पष्टीकरण के बाबजूद यदि आंदोलनकारियों के लिए यह एक मुद्दा है तो रहे, किन्तु कृषि कानूनों से अलग। ये कानून रहें या जाएं, न्यूनतम समर्थन मूल्य का मुद्दा जहाँ का तहाँ बना रहेगा। अतः इसका कृषि कानूनों से जोड़ा जाना, एक छलावा मात्र है।
